1. Overview
GIGDATA LLC ("Company," "we," "us") operates the ITAD Tools platform at itadtools.com. We respect the intellectual property rights of others and expect our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), codified at 17 U.S.C. § 512, we will respond promptly to claims of copyright infringement committed using our platform.
The ITAD Tools platform allows users to submit reviews, ratings, product listings, and other user-generated content. If you believe that any content on our platform infringes your copyright, please follow the procedures described below.

3. Filing a DMCA Takedown Notice
If you are a copyright owner, or authorized to act on behalf of one, and believe that copyrighted material has been posted on or through the ITAD Tools platform in a manner that constitutes copyright infringement, please submit a written notification to our Designated Agent containing the following information, as required by 17 U.S.C. § 512(c)(3):
- Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed. If multiple copyrighted works are covered by a single notification, you may provide a representative list of such works.
- Identification of the infringing material: Identification of the material that you claim is infringing and that you request be removed or access to which be disabled, with enough information to allow us to locate the material. Please provide the specific URL(s) where the material appears.
- Your contact information: Your name, mailing address, telephone number, and email address.
- Good faith statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Accuracy statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Signature: A physical or electronic signature of the copyright owner or a person authorized to act on the owner’s behalf.

4. Counter-Notification Process
If you believe that material you posted on the platform was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with our Designated Agent. Your counter-notification must include the following information, as required by 17 U.S.C. § 512(g)(3):
- Identification of removed material: Identification of the material that was removed or to which access was disabled, and the location at which the material appeared before it was removed or disabled.
- Statement under penalty of perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if you are outside the United States, the Central District of California), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
- Your contact information: Your name, address, and telephone number.
- Signature: Your physical or electronic signature.
Upon receipt of a valid counter-notification, we will forward it to the party who submitted the original takedown notice. If the original complainant does not file a court action seeking a restraining order against you within 10 business days, we will restore the removed material within 10 to 14 business days after receiving the counter-notification.
5. Repeat Infringer Policy
In accordance with the DMCA and other applicable law, we have adopted a policy of terminating, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the platform and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Please be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys’ fees. If you are not sure whether material available online infringes your copyright, we recommend contacting an attorney before filing a DMCA notification.

We reserve the right to modify this DMCA Policy at any time. When we make material changes, we will update the "Last updated" date at the top of this page. We encourage you to review this policy periodically.
